§ 38-28. Prohibited activities.

  • (a)

    Interfering with city personnel. No person shall hinder or oppose any officer, agent or employee in the discharge of his duties or with the enforcement of the park regulations and rules.

    (b)

    Entering, remaining during closing hours. No person shall enter or remain in a park or recreational area without a permit during and after closing hours, if the closing hours are posted at the entrance of the park or recreational facility. No person shall enter or remain in a park or recreational facility after 10:00 p.m. or before 8:00 a.m.; provided, however, in the event there is any city sponsored or permitted, endorsed, or approved event occurring at such park, then the hours as set forth herein shall be extended for a time to include one hour before such event and one hour after the termination of such event.

    (c)

    Duty to leave on request. No person who has violated a rule shall remain in a park or recreational facility after the park director, police officer, sheriff's deputy, or employee of the city requests such person to leave or vacate a park or recreational facility.

    (d)

    Damaging property. No person in any park or recreational facility shall wilfully mark, deface, disfigure, injure, tamper with, displace or remove any building, bridges, tables, benches, railings, paving or paving material, water lines, or other public utilities or parts or appurtenances whatsoever, either real or personal in any park or recreational facility.

    (e)

    Damaging vegetation. No person in any park or recreational area shall remove, damage, cut, carve or transplant, any tree, shrubbery, lawn, plant or injure the bark or pick the flowers. No person shall attach any rope, wire or other contrivance to any tree or plant in any park or recreational facility without expressed written permission.

    (f)

    Removing natural resources. No person in any park or recreational facility shall remove any soil, rock, stones, plants, wood or other materials, make any excavation by tool, equipment, blasting or other means or agency.

    (g)

    Polluting waters. No person in any park or recreational facility shall throw or place of cause to be thrown or placed, any dirt, filth or foreign matter into the waters of any lake, pond, pool, river, inlets tank or reservoir.

    (h)

    Disposal of rubbish. No person in any park or recreational facility shall throw, place, cast, deposit, dump or cause to be thrown, any ashes, refuse, offal, vegetables, garbage, grass, cinders, shells, straw, shavings, paper, scraps, dirt or like matter, filth or rubbish of any kind in any park, square, avenue or grounds adjacent to or in any recreational area, except to place the same in cans or receptacles provided for such matter.

    (i)

    Hunting, molesting wildlife. No person in any park or recreational area shall hunt, catch, harm, kill, trap, chase, tease, shoot or throw missiles at any animal, reptile or bird. No person in any park or recreational areas shall remove or have in his possession the young of any wild animal or eggs or nest or young of any reptile or bird.

    (j)

    Alcoholic beverages. No alcoholic beverages shall be sold, stored or consumed within any park or recreational area, except by approval of the mayor and city council for sales or consumption at special events.

    (k)

    Drugs. No person shall possess or consume cannabis or other controlled substances as defined in F.S. ch. 893, in any park or recreational facility.

    (l)

    Fires. No person in any park or recreational area shall ignite, set or maintain any fire for cooking or any other purpose unless such fire is within a designated area for such purpose. Notice of such activity shall be given upon application.

    (m)

    Firearms and fireworks. No person in any park or recreational area shall carry, fire or discharge any rocket, torpedo or other fireworks of any description without a permit from the city to discharge same in an area designated for such purpose. Such activity shall be approved or supervised by the City of Hialeah Gardens Police Department.

    (n)

    Distributing literature. No person in any park or recreational area shall distribute any handbill, circular, booklet, leaflet, flyer, card, pamphlet, sheet, written or printed matter without causing the removal of any discarded material or paper from the park or recreational facility prior to leaving the park or recreational facility.

    (o)

    Conducting, participating in unpermitted meeting. No person shall conduct or participate in any public meeting, assembly, entertainment, tournament, religious gathering, demonstration, parade, procession or meeting on any subject, religious, social, political or otherwise, in any park or recreational area, unless a permit from the city has been issued for such meeting, assembly, entertainment, tournament, religious gathering, demonstration, parade or procession in accordance with F.S. ch. 98.08.

    (p)

    Sound amplifiers, musical instruments. No person shall use any loudspeaker or other amplifying equipment nor shall any person play upon any musical instrument in any park or recreational area without a permit from the city.

    (q)

    Sales. No person shall sell, keep, or offer for sale any tangible or intangible object, merchandise or thing for any consideration within any park or recreational area without a permit from the city.

    (r)

    Signs or posters. No person shall post or affix to any tree, shrub, plant, fence, building, structure, monument, wall, table, apparatus, bridge, post, bench, corral, gate or any other physical object, any sign, poster or other printed or written matter in any park or recreational facility without expressed written approval by the city.

    (s)

    Sleeping, camping, overnight parking. No person shall sleep, camp, lodge or park a vehicle overnight in any park or recreational area except in such areas as are designated for such purposes or without a permit from the city.

    (t)

    Animals. No horse, dog, cat or other animal shall be brought upon any park property.

    (u)

    Motorized vehicles and the like. No go-carts, motorized bikes, inclusive of dirt bikes and motorcycles, automobiles, or terrain vehicles shall be brought upon park property or driven on park property, excepting only such vehicles as are used by park personnel for park purposes.

    (v)

    Skating, skate boards and bicycles. The use of skates, skateboards and bicycles are prohibited, except on paths (if any) which have been duly designated for such use.
