§ 40-185. Purchase of Credited Service for Period of Military Service Prior to Employment with the City.

  • Participants of the Pension Plan shall have the option to receive credited service for all purposes of this pension trust fund for periods of active military service in the armed forces or the merchant marine service of the United States prior to City employment under the following conditions and subject to any restrictions established by applicable law:

    (1)

    Participants who wish to receive credit for such active military service shall be required to:

    a.

    Provide proof, to the satisfaction of the Board of Trustees, of the participant's active military service in the armed forces or merchant marine of the United States; and

    b.

    Make a contribution for such credited service in an amount established by a formula and payment by methods as determined by the Board of Trustees, which shall be administered in a uniform and nondiscriminatory manner.

    (2)

    Participants shall within one hundred eighty (180) days following the date the participant attains ten (10) years of credited service under this Pension Plan be required:

    a.

    To make an irrevocable election to purchase active military service time; and

    b.

    To elect the amount of active military service time to be purchased.

    (3)

    Once a time period is chosen for purchase, adjustment of the time period shall not be permitted. If an election to purchase active military service credit is not received in such time period, no future election shall be allowed.

    (4)

    Each Participant shall be an employee of the City on the date of the election and shall have a total of ten (10) years of credited service with the City immediately prior to the date of such election to be eligible to purchase credit for active military service.

    (5)

    Participants eligible to purchase credit for active military service time may purchase such active military service time on a day-for-day basis up to a maximum of five (5) years.

    (6)

    In no event may a participant purchase more active military service credit (on a day-for-day basis) than was actually spent on active military service in the armed forces or merchant marine of the United States.

    (7)

    There shall be no age limit for any participant who wishes to purchase active military service time.

    (8)

    Participants shall be limited to a maximum combined total of five (5) years of purchased credited service for active military service and service with other public law enforcement employers.
