§ 42-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, unless otherwise provided, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    City approved collector means an entity which has contracted with the city to provide garbage and trash collection within the city limits.

    Commercial establishments means any hotel, motel, apartment house, roominghouse, or tourist court which contains three or more service units, and any other building, business, or establishment of any nature or kind whatsoever other than a residential unit.

    Container means a galvanized metal, durable plastic, or other suitable material container of the type commonly sold as a garbage can, having a tightfitting metal or plastic top with handle, a waterproof bottom, and constructed so as to permit the free discharge of its contents.

    Garbage means every refuse accumulation of animal, fruit, or vegetable matter that attends the preparation, use, cooking, dealing in, or storage of edibles, and any other matter of any nature whatsoever which is subject to decay, putrefaction, and the generation of noxious or offensive gases or odors, or which, during or after decay, may serve as breeding or feeding material for flies or other germ-carrying insects or as an attraction to animals.

    Garbage can means a plastic or galvanized metal container of the type commonly sold as a garbage can, of a capacity not less than 20 gallons and not to exceed 30 gallons, unless otherwise issued by the city, having two handles upon the sides thereof, or a bail by which it may be lifted, and a tight fitting metal or plastic top with handle, and so constructed as to permit the free discharge of it contents.

    Garden trash means all accumulations of leaves, grass, shrubbery, cuttings, and other refuse attending the care of lawns, shrubbery, vines, and trees.

    Health nuisance means any condition which exists and affects or could affect the state of being hale, sound or whole in body or mind of any resident of the city or relates to a sanitary condition or infectious or deleterious health influence.

    Health officer means a person appointed by the mayor, ratified by the city council, who may be a building official or code compliance officer.

    Industrial wastes means the waste products of canneries, slaughterhouses, or packing plants, condemned food products, agricultural waste products, wastes and debris from brick, concrete block, roofing shingle or tile plants, debris and wastes accumulated from land clearing, excavation, building, rebuilding, and altering of buildings, structures, roads, streets, sidewalks, or parkways, and any waste materials which, because of their volume or nature, do not lend themselves to collection and incineration commingled with ordinary garbage and trash, or which, because of their nature or surrounding circumstances, should be, for reasons of safety and health, disposed of more often than the city collection service schedule provided for in this chapter.

    Mobile container means a garbage and waste container which is flyproof, ratproof, and leakproof, and which shall be fitted with covers. The container shall be mounted on four wheels or metal slides and be capable of fitting hydraulic attachments for unloading.

    Noncombustible refuse means refuse materials that are unburnable at ordinary incinerator temperatures (800 degrees to 1,800 degrees Fahrenheit) such as metals, mineral matter, large quantities of glass or crockery, metal furniture, auto bodies or parts, and other similar materials or refuse not usual to housekeeping or to operation of stores or offices.

    Plastic bag means a polyethylene or other heavy-duty plastic bag with securing twist-tie.

    Residential unit means any structure or shelter or any part thereof used or constructed for use as a residence for one family.

    Rubbish means refuse, accumulations of paper, excelsior, rags, or wooden or paper boxes or containers, sweepings, and all other accumulations of a nature, other than garbage, which are usual to housekeeping and to the operation of stores, offices, and other business places; also, any bottles, cans, or other containers which, due to their ability to retain water, may serve as breeding places for mosquitoes or other water-breeding insects. Such term shall not include noncombustible refuse, as defined in this section.

    Service unit means four sleeping rooms, or a fraction thereof, where no cooking privileges are provided, located in any commercial establishment.

    Trash means items or material, other than so defined as garbage in this section, of a nonperishable nature.

    Waste means garbage, rubbish, garden trash, noncombustible refuse, and industrial wastes, as defined in this section.
