§ 42-2. Garbage containers.

  • (a)

    No person shall leave for street side pickup any garbage unless contained in a container as that term is defined in section 42-1. No person shall leave for street side pickup any trash unless contained in a container or plastic bag as those terms are defined in section 42-1. Persons desirous of having garbage or trash picked up by collection services shall place the garbage or trash in an area designated by the collection service on the morning of the scheduled collection date.

    (b)

    Each commercial establishment located in the city shall have a sufficient number of garbage cans to accommodate all garbage and waste to be removed by the city or other approved agency and each residential unit in the city shall have a minimum of one garbage can for that purpose. Collection service may be discontinued where containers have been condemned as unfit for garbage receptacles until proper containers are provided, and the owners or users thereof may be subject to the provisions of section 1-16. Garbage cans shall be kept tightly covered at all times, shall be capable of being closed so that water, flies, and other insects cannot enter, and shall be easily accessible to the refuse collectors on the property from which the refuse originated. All garbage which is placed therein shall be thoroughly drained of all liquid matter and well wrapped in paper before being placed in the garbage can or mobile container.

    (c)

    Where an alley exists and is normally used for the collection of garbage, garbage cans shall be placed on the owner's property as near to the alley as is practicable. If no alley exists, or use of the alley is not practical by reason of the existence of physical obstacles to the placement of the garbage can or mobile container on the edge of the alley, the garbage can or mobile container shall be placed at a point to be designated by the director of the sanitation department.

    (d)

    It shall be a violation of this chapter to place or cause to be placed in a garbage can or refuse container for collection any acid, explosive material, inflammable liquids, or any dangerous or highly corrosive material of any kind.
