§ 42-5. Duty of owner and tenant.

  • (a)

    Accumulations prohibited. It shall be the duty of the owner and the tenant of each lot, tract or parcel of land, residence, commercial establishment or other property within the city limits to prevent the continued excessive and unsightly accumulation of garbage, garden trash, or other types of trash, waste, rubbish, construction debris or refuse upon the property owned or occupied by the owner. Failure to comply with the provisions of this section shall constitute a violation of this chapter.

    (b)

    Collection service required. It shall be the duty of the owner and the tenant of each occupied lot, residence, commercial establishment, parcel of land or other property within the city limits to obtain regular garbage and trash collection services from the city-approved collector. Failure to comply with the provisions of this section shall constitute a violation of this chapter.
