§ 46-34. Application.

  • (a)

    The applicant will file an application for certificate of use using the form prescribed by the local business tax receipt department and such license will not be issued unless all applicable required information, review and approvals are provided with the application. In cases in which the approval of a governing agency is required the applicant shall also file proof of approval from such governing agency.

    (b)

    Every person engaged in or managing any business, profession, service or occupation in the City of Hialeah Gardens referred to in this article, is required to procure a city license as herein provided and shall, on or before October 1 of each year, and always before engaging in any business, profession, service or occupation, file an application on the prescribed form with the local business tax receipt department, signed by an officer, partner, or owner of the business.

    (c)

    All licenses shall be applied for and issued in the real name of the applicant. In cases where the applicant has qualified under Florida laws for the use of a "fictitious name," the license, if issued, shall show the real name as well as the "fictitious" name of the applicant. In such application, the applicant shall set forth the name of the owner; if a firm, the names of all members of the firm; if a corporation, the names, addresses and telephone numbers of all officers of the corporation; the location of the business, the full nature of the business, additional information or approvals as prescribed in the application and the certificate of use; where the fee is based on inventory, number of vehicles, seats, employees, gasoline pumps, apartments units, trailers, square footage or any other unit used as base for the calculation of the license or regulation established by the local business tax receipt department.

    (d)

    The code compliance department will inspect the business premises to verify other information in the application such as numbers of vehicles, seats, employees, gasoline pumps, apartments units, trailers, square footage or other units used in the calculations of the license fee, declared by the applicant.
