§ 54-71. Injurious conditions—Enumerated.

  • The following conditions existing, permitted, maintained, kept, or caused by any individual or entity shall constitute a condition injurious to health:

    (1)

    Untreated or improperly treated human waste, offal, dead animals or parts thereof, human parts, waste derived from hospitals, or dangerous waste materials from manufacturing processes harmful to human or animal life, and air pollution and gasses which are harmful to human or animal life.

    (2)

    Improperly built or maintained septic tanks, water closets, or privies.

    (3)

    Discharging or allowing the discharge of septic tank pump-out waste or the discharge of any other product, chemical, or waste which can damage underground aquifers into streams or surface waters or underground aquifers, or into ditches, drainage structures, or on the ground surface.

    (4)

    Radioactive material.
