§ 30-2. Health officer, powers and duties.

  • (a)

    The health officer shall have the following powers and duties:

    (1)

    The health officer is authorized to inspect premises to determine if a health nuisance exists and to do all things necessary to abate or cause the prosecution of those responsible for such health nuisances.

    (2)

    The health officer is authorized to enforce all of the requirements of state laws, county or city ordinances and resolutions in regard to sanitary regulations which are calculated to guard against epidemics, infectious, contagious, or malignant diseases or other matters which tend to affect the health of the residents of the city.

    (3)

    The health officer is authorized to have notice served upon the owner, lessee, or occupant or any agent, servant, representative, or employee of the owner, lessee, or occupant of the property on which any health nuisance exists for its removal or abatement and to specify a reasonable time within which it shall be done.

    (4)

    The health officer shall be responsible for the enforcement of the provisions of any and all ordinances or resolutions of the city in relation to garbage and trash and shall be responsible to see that such regulations are strictly complied with.

    (5)

    The health officer shall have the authority to enforce any and all laws relating to health, whether promulgated by the state, the county or the city.

    (b)

    In the fulfillment of his duties, the health officer is authorized to enlist the aid of the police department. In this regard, the police department shall cooperate fully with the health officer for the purpose of obtaining for the health officer, when needed, entry upon premises wherein a health nuisance is believed to be occurring, the serving of the prescribed notice wherein a health nuisance is found to exist, or the investigation of such alleged health nuisance.
