§ 46-49. Roadside vendors and peddlers.

  • (a)

    No roadside vendor shall engage in or manage any business, without first obtaining a certificate of use and such license and paying the required fee.

    (b)

    Roadside vendors who become stationary and wait for customers to approach them for an unreasonable period of time, unreasonable defined as five minutes or more, are in violation of this article. It's illegal to sell merchandise from parked vehicles or open stands along a public street or right-of-way. There is an exception for vendors who keep on the move and stop on the swale area, where are not posted "NO PARKING OR STOPPING ANY TIME" only long enough to serve one customer at the customer's request.

    (c)

    Habitual violation by licensee, his employee or patrons has occurred more than two times, the code compliance officer, hereby authorized to charge an administrative fee of $50.00 to any individual or entity that fails to comply with any provisions of the section. If there has occurred a violation of this article of the ordinance the code compliance officer is hereby authorized to issue a civil citation fee of $50.00 to any individual or entity that fails to comply with any provisions of the section.

    (d)

    If habitual conduct by licensee, his employees or patrons has occurred, which violates section 46-52(3) and requires frequent need for police or code compliance departments to act at the premises because of such conduct. The city council shall have grounds for suspension or revocation of the local business tax receipt.
