§ 46-50. Development orders and certain types of permits.

  • Development orders or development activity sets forth the local business tax receipt department for the application review procedures required for obtaining a local business tax receipt of the following activities:

    (1)

    Building, installing, enlarging, replacing or substantially restoring a structure, impervious surface, including long-term storage of materials;

    (2)

    Erection of a permanent sign unless expressly exempted by the land development regulations pertaining to the City of Hialeah Gardens;

    (3)

    Alteration of any bay on the warehouse area, increasing the minimum requirements for off-street parking established by the land development regulations pertaining to the City of Hialeah Gardens;

    (4)

    Any reduction of parking requirements on existing warehouse or conflict with the loading spaces;

    (5)

    In the event that any question arises concerning the application, the use, regulations, performance standards, definitions, development criteria, or any other provisions of this article, the chief zoning and code compliance official shall be responsible for interpretation and shall look to the city comprehensive plan for guidance. Responsibility for interpretation by the said official shall be limited to standards, regulations and requirements of this Code, but shall not be construed to include interpretation of any technical codes adopted by reference in this Code, nor be constructed as overriding the responsibilities given to any council, board or official named in other sections or articles of this Code.
