§ 50-31. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings given in this section, except where the context clearly indicates a different meaning:

    Code compliance board means the city's code compliance board, established pursuant to F.S. ch. 162, known as the Local Government Code Enforcement Boards Act.

    Code compliance department means the city's code compliance department and shall include all individuals employed by the department as code compliance officers who have been designated by the city as such and whose duty it is to enforce the land development code and ordinances enacted by the city and the provisions of the South Florida Building Code, and statutes of the state and the ordinances of the county and the city, including the city building official.

    Commercial district means any area of the city which is zoned for usage other than residential and shall include those areas zoned CM.

    Commercial vehicle means a truck, bus, trailer, semitrailer, truck tractor and semitrailer combination, recreational unit or camper primarily designed as temporary living quarters, which either has its own motor power or is mounted on or drawn by another vehicle being operated or capable of being operated on the highways of the city, and designed to be used to transport cargo or passengers in commerce.

    Highway means any public thoroughfare including streets, alleys, avenues, roads, rights-of-way and any other area which is open for vehicular travel by the general public unless otherwise excluded in this article.

    Off-street parking areas means those areas of real property including parking spaces, loading spaces, driveway areas and other areas which have been designated for the purpose of temporary parking when the keeping or parking of commercial vehicles is necessary to the operation of the business enterprise located on such property, or any other appropriate storage place or lot maintained in a location so designated for the purpose of parking.

    Operator means any person who is in actual physical control of a motor vehicle upon the highway or who is exercising control or steering a vehicle being towed by a motor vehicle.

    Overnight parking means those hours between 6:00 p.m. and 7:00 a.m. daily.

    Parked means the state of a vehicle being temporarily left unattended by its owner and/or operator.

    Passenger vehicle means only those vehicles designed, used or maintained primarily to transport private passengers and which are currently licensed for travel on the public highways and are capable of and equipped to be lawfully operated in such fashion under their own power.

    Person means any individual, firm, partnership, joint venture, syndicate or other group or combination acting as a unit of economic organization or activity and shall include the plural as well as the singular.

    Police department means any member of the city police department who is certified pursuant to state law and who has the authority to make arrests and to enforce the penal, criminal, traffic or highway laws of the state.

    Private property means all land and improvements and personal property not owned by the state, the county or the city and lying within the geographical boundaries of the city.

    Property owner means that person who exercises dominion and control over private property, real or personal, including, but not limited to, the legal titleholder of a commercial vehicle as defined in this section, a lessee or any person authorized to exercise or share dominion and control over private property.

    Public property means all land and improvements owned by the state, the county or the city, including, but not limited to, buildings, grounds, parks, playgrounds, streets, sidewalks, parkways, rights-of-way, easements and other similar real property lying within the geographical boundaries of the city.

    Right-of-way means the outside boundaries of a highway, whether such right-of-way has been established by usage, dedication, by the city's official right-of-way map or records or in any other fashion recognized by law.

    Weekend means and includes all hours between 7:00 p.m. on Friday and 7:00 a.m. on the following Monday.
