§ 54-1. Authority of the water and sewer department.

  • (a)

    There is hereby established a department of water and sewer. The department shall be administered by a department head appointed in accordance with the provisions of the Charter.

    (b)

    The department of water and sewer shall exercise exclusive supervisory control over the operation of the water distribution of the city, together with any extensions thereof, and the sanitary sewer system of the city, as well as the treatment and disposal of sewage thereof.

    (c)

    The water and sewer department shall operate the water and sewer systems as an enterprise. All costs, expenses, capital improvements, salaries, fees and other appropriate and necessary expenditures shall be paid out of the revenues generated by the sale of water and sewer services and other moneys resulting from the operation of the water and sewer systems. The water and sewer department shall maintain a separate budget as may be approved by the city council. All revenues of the water and sewer systems shall be segregated and deposited in a fund separate and apart from the general funds of the city and used to meet the operation, maintenance, depreciation, labor, interest, bond retirement, sinking funds requirements and additions and improvements or other necessary expenses and indebtedness properly assigned to the operation of the water and sewer systems including personnel, salaries, advisory fees, engineering fees, attorney fees, and other appropriate matters.

    (d)

    Contracts for water and sewer services may be entered into in the name of the city by the water and sewer department as may from time to time be authorized by the city council and approved by the mayor.

    (e)

    The water and sewer department shall operate within the framework as set forth in the ordinances and resolutions of the city.

    (f)

    The water and sewer department may establish rules and regulations governing efficient operation of the water distribution system and the sewer system of the city. Rules and regulations shall be submitted to the water and sewer board at public hearing after at least ten days' notice published in a newspaper of general circulation within the city. The water and sewer board may approve, delete, amend, change, or modify any proposed rule or regulation after public hearing thereon. All rules and regulations adopted by the water and sewer board shall be submitted for approval to the city council who may adopt, reject, or amend such rules and regulations by ordinance. No rules or regulations shall become effective until adopted by ordinance by the city council.
