§ 54-1.1. Water and sewer advisory board.

  • (a)

    There is hereby established a water and sewer advisory board in accordance with the provisions of the Charter, article VIII, section 5. A member shall be an individual of outstanding reputation for integrity, responsibility and business ability. No person who is an officer or employee of the city in any other capacity shall be a member of the water and sewer board. The advisory board shall assist the city council in all matters relating to the operation and maintenance of the water and sewer systems, rates, condition of the system, efficiency of its operations, capital requirements, financing, costs and expenses and other appropriate and necessary matters as may be requested by the mayor or city council by resolution.

    (b)

    The water and sewer advisory board shall meet monthly in regular meeting and in special meetings as may be requested by the mayor or city council. The board shall inquire into the management of the water and sewer systems of the city, financial requirements, rates, and all policy matters relating thereto and advise the city council and the mayor as to their findings and recommendations.

    (c)

    The water and sewer board shall advise the mayor and the water and sewer department head as to all matters relating to the water and sewer systems of the city, including but not limited to capital requirements, financing, rate structure, and management of the system. The board shall advise the city council of its findings and recommendations relating thereto. In addition, the board shall recommend rules and regulations relating to the efficient operation of the water and sewer systems which shall be effective upon adoption by the city council by ordinance.

    (d)

    Rates for water and sewer services shall be established in the following manner:

    (1)

    The mayor or city council shall request the water and sewer board to consider the appropriateness of water and sewer rates and charges. The board shall hold a public hearing at which time it shall receive evidence relating to the need and necessity of rates and charges. The board shall permit all members of the public to request information, comment on the appropriateness of the proposed rates, and present other matters in relation thereto.

    (2)

    The board shall recommend appropriate rates and charges to the city council together with such findings and recommendations that it deems appropriate.

    (3)

    The city council shall hold a public hearing as to the need and necessity of the proposed rates and charges. At the public hearing the city council shall hear the recommendations of the mayor or department head and the recommendations of the water and sewer board and the comments of all interested members of the public. Thereafter the city council shall establish the rates and charges by resolution.

    (4)

    All rates and charges for water and sewer services shall be sufficient to defray all costs and expenses of the water and sewer systems, including but not limited to bond issue requirements, capital improvements, salaries, expenses, maintenance, depreciation, interest payments, and other necessary expenses and indebtedness of the water and sewer systems.

    (e)

    Bonds, special assessments, and other financing of water and sewer systems shall be approved by the city council.
