§ 54-3. Water and sewer board resolutions.

  • Competent evidence, for the purpose of this section, means testimony or writings which, in the opinion of the city council, enable it to determine questions of fact presented. Such testimony evidence need not be sworn to and may contain heresay, and any writings need not be authenticated. All resolutions of the water and sewer board shall come to the city council with a presumption of correctness, and the city council shall not overrule, reverse or amend such resolutions or rules without there existing, at a hearing on the matter, competent evidence supporting the decision to overrule, reverse or amend such resolution or rule of the water and sewer board.
