§ 2-75. Presiding officer.

  • (a)

    The chairperson of the city council shall preside at all meetings at which he is present. In the absence of the chairperson, the vice-chairperson of the city council shall preside. The chairperson and vice-chairperson shall be selected by the city council pursuant to the guidelines set forth in the Charter, article III, section 2C. The presiding officer shall preserve strict order and decorum at all meetings of the city council. He shall state every question coming before the city council and announce the decision of the council on all matters coming before it.

    During periods when the chairperson is also the acting mayor, the chairperson may, at any meeting such chairperson desires, delegate to the vice chairperson the duties required to preside over city council meetings to facilitate the acting mayor's consideration of issues before the council, provided it shall always be the chairperson's responsibilities to preserve strict order and decorum at all meetings of the city council.

    (b)

    A majority vote of the city councilmembers present shall govern and conclusively determine all questions of order not otherwise covered. The presiding officer shall vote on all questions, his name being called last. The presiding officer shall be further permitted to offer any motion or resolution from the chair.

    (c)

    In the absence of the chairperson, or in the event of his inability to serve by reason of illness or accident, the vice-chairperson shall perform the duties and functions of the chairperson until his return to the city or recovery and resumption of duty.
